中選會遭控寬嚴不一原民立委鄭天財：公投審查標準好奇怪！

立法院內政委員會今（2）日進行「公民投票法修正後現行公民投票制度運作之檢討」專案報告，中選會主委陳英鈐遭原民立委鄭天財（Sra．Kacaw）砲轟審查公投提案的標準很奇怪，有違憲疑慮的公投提案寬鬆審查，但沒有違憲的公投提案卻嚴加審查，使得中選會陷入踰越大法官權限的爭議。

阿美族立委鄭天財在質詢時，特別關注幸福盟提出的適齡性平教育公投，他質疑中選會審查標準寬嚴不一，中選會對於涉及領土變更的公投案（指紀政提出的「東京奧運台灣正名公投」）寬鬆審查，對於無違憲爭議的適齡性平教育公投卻百般刁難，以違憲為由要求召開聽證會。

「（法條）完全沒有授權（中選會）依大法官解釋做審查！」鄭委員抨擊，違憲審查是大法官職權，不是中選會職權，中選會應謹守份際。

鄭天財委員引述《公投法》修法說明，指出中選會的職權是「除程序要件是否完備外，實質內容不應受到政府機關的審查。」至於公投法第二條的「依憲法規定」，按眾委員修正意見，專指公投若涉及憲法條文的修正、領土的變更，應依憲法增修條文規定處理。

接著，鄭委員批評中選會審查適齡性平教育公投的標準很奇怪，他質疑這項公投沒有涉及修憲，為何中選會還要進行違憲審查？中選會陳英鈐於答覆時，多次跳針引述大法官748號解釋的「婚姻自由」保障，指出不應對人民有性傾向的差別待遇。但鄭委員打臉，適齡性平教育公投是針對「同志教育」是否在中小學實施進行公投，且公投的對象是《性別平等教育法》的「施行細則」，跟違憲或平等權沒什麼關係。若人民發起公投，討論人民在成年、18歲或16歲該受什麼教育，這些在憲法都沒規定！

當幸福盟公投遭到百般刁難時，鄭天財質疑中選會對涉及領土變更的公投大放水。鄭委員引述紀政的「東京奧運台灣正名公投」的提案說明，認為該公投已經涉及法理台獨和領土變更，他抨擊「涉及領土的範圍，你們竟然認為沒有違憲！然後對於同志教育，竟然認為涉及違憲，真的是很奇怪！」

最後，鄭委員針對聽證程序，他強調「聽證的用意，不是為了要封殺！」他質疑中選會在聽證會找來的專家學者，沒有經過公開徵選程序，都是中選會自己決定的人選。（政治中心 / 綜合報導）
